BHM Golf - Sued!

Finally, some action against BHM Golf and their despicable business practices - the following is from the Chicago Better Business Bureau website:

 

Per a December 28, 2007 press release, Illinois Attorney General Lisa Madigan's office filed a lawsuit today against BHM Golf, a company that faces a range of allegations including the failure to provide consumers with purchased products. The suit, filed in DuPage County Circuit Court, names Brian H. Meyer, doing business as BHM Golf of Villa Park, as the defendant.

 

Madigan's Consumer Fraud Bureau and the Better Business Bureau have received more than 200 consumer complaints about Meyer's business practices. According to the consumers' complaints, BHM Golf allegedly has:

 

- failed to send consumers the products they purchased,

 

- sent consumers the wrong products,

 

- sent consumers damaged or unusable products,

 

- advertised products that were not in stock,

 

- waited several months to ship purchased products,

 

- overcharged consumers for products,

 

- advertised no delivery charges and subsequently charged consumers a shipping fee,

 

- failed to answer consumers' telephone calls and e-mails regarding service complaints, or acted in a belligerent and abusive manner in response to consumer complaints or inquiries, and

 

- refused to refund consumers' accounts for failure to deliver, delivery of the wrong product or overcharges.

 

Madigan's lawsuit alleges that Meyer violated the Illinois Consumer Fraud and Deceptive Business Practices Act and asks the court to prohibit Meyer from engaging in the business of selling sporting goods over the Internet and from further violating Illinois' consumer protection laws. The lawsuit seeks restitution to consumers and court costs.

 

In addition, Madigan's suit seeks a civil penalty of $50,000 and additional penalties of $50,000 for each violation found to have been committed by Meyer with the intent to defraud.

I'm not surprised to see this. There was a thread not too long ago that talked about the Illinois AG was hot on his Word not allowed. It's good to see he's finally getting what he deserves. I think there are many on this board who have had bad dealings with Brian and may even have made some of those complaints.

This is a long time coming...I tried to order a Yes! putter and we were haggling over price...I ended up going with another guy that had a lower price. He told me he would beat his price if I told him who was offering it and for how much. I pointed him to the website and I got a call back from the guy at BHM CURSING me that the website was not an authorized Yes! retailer and he couldn't sell Yes! equipment without being authorized and blah, blah, blah...I asked him how this was my problem.

 

I went with the other guy and I got a handwritten letter in the mail from the guy at BHM about how consumers like me are killing the golf industry because we are running authorized dealers out of business. He ended the letter with something like, "I hope you can sleep tonight knowing that you are putting honest people out of business. You are the worst kind of person to me. You are an insincere *****."

 

I was appalled I got this letter from him and I called him. He immediately started apologizing and saying he was busy and that he shouldn't have sent the letter, but he had a bad day on that particular day. I told him that wasn't acceptable and he hung up on me.

 

What a *****.

Sad to see that someone treats their customers this way. I ordered some stuff from Brian last sping and I got the wrong hat when I received the merchandise. It took forever to get the right hat and he did have an attitude and never did return any calls. I wouldn't wish legal trouble on anyone, but sounds like this is long overdue. Too bad Brian didn't realize that excellent customer service is one of the keys to surviving in this golf business.

The article re the suit of Brian Meyer details my experiences with him exactly. The whole experience was so bizarre/unbelievable that I almost looked forward to the next ridiculous scenario/excuse. How do I get in on the suit? I have saved all documentation.

 

Contact the Illinois attorney general's office:

 

Consumers who believe that they may be the victim of consumer fraud can download a consumer complaint form at www.illinoisattorneygeneral.gov/consumers or call the Attorney General's Consumer Fraud Hotline at (800) 386-5438 or the Spanish-language Hotline, at (866) 310-8398.

I know of people who have had some unfavorable dealings with this guy.

Rude doesn't begin to describe his manner.

 

Thankfully a good credit card company will go to bat on your behalf if you have been wronged....

Well son of a b--tch!! Wish I would have know this a few weeks ago. I ordered some stuff from him and have been having hell with him. This explains it all. Bad thing for him is that I am a State Police Officer assigned to Investigations so I will have to make a little phone call to my buddies at the Illinois AG's Office :wub:

I found the Adidas Powerbands on his site last year just after they came out. He had the best price around and my Dad ordered them for me for my birthday. Everything went smoothly from what I remember. Guess I really lucked out, I would have felt like a real a** if he would have screwed my Dad over after I sent him there on my behalf. Good luck to anyone seeking restitution from this guy.

Damn.. This gut, "Brian" did it to me. I was googling Bridgestone Tour Gloves, and this BHM site came, and web site stated they have in stock, so I ordered 5 pairs using paypal.

A week later, package came, and surprised. he shipped 10 pairs of Nike Dri-Fit gloves. (discontinued ones. 2003 or 2004). So Im pis$ed, and I called him. No answers, left him a voice mail. He returened my call, but he said that he doesnt have Bridgestone in stock, so he shipped 5 more pairs of Nike. he said that he is not in office, and tell me call him on Monday. Can I distribute to Paypal, and have paypal to credit my money back or do I need to contact my bank (original source to my paypal account). I just dont trust this guy.. If I sent that package without my refund, Im affraid he might not give me refund...

Anyway, it was my mistake not to check BHM out first in GolfWrx, but I was lazy and naive.... :clapping:

I am updating each thread concerning BHMGOLF.COM in order to insure that the word is out!

 

They are not legitimate online seller in the sense of TGW.com or Morton Sales or Golfio.com. I had inquired about some equipment from an OEM. Most had a statement which stated "Call for Availablility". When calling, I received a message to leave a number and that I would receive a call back later. I also emailed them with the specifics.

 

24 hours later with no reply I called again. Some guy on the other end that sounded like his nose was runny, picked up. I inquired about the product. At first I got a reply that nothing was in stock. I pursued my questioning. Nothing? "Well very little." So I began to ask about each item. One after the other was no, no, no. I then said, "I must ask, if you don't have any of this in stock, why have all of it still listed?" If I hadn't called, some of the items I might have purchased, and provided payment. To which Runny Nose replied, "It would have just put an authorization on your card." As if that made it o.k.

 

Then I was hung up on. Knowing that I could have just lost the connection, I called back only to be answered by a loud fax type tone. I tried back again. Runny Nose answered. I repeated my last question adding, "don't you think you should remove the items?", to which he said, "I don't have to" and hung up.

 

This smells of a business being run out of a garage with nothing but a decent looking web page. The problem that this guy doesn't know, is that you cannot knowingly leave items unavailable on you site for an inordinate amount of time. It is a violation. One that I will publicize and pursue.

can anyone help me, i just ordered a new xls fairway wood yesterday and just decided to search this site today to see if there was any info on the site, im an idiot i should have looked prior to ordering, this sucks, its only been 1 day so i dont know if there will be a problem yet, any advice for this idiot here

After reading all of this I would recommend you call back today to ask for shipping information (tracking). If he can't provide it, cancel your order immediately, and place a credit hold through your credit card company. If he gives you a tracking number, check it immediately for verification. It sounds as though he'll try every trick in the book to keep you at bay.

i called my credit card company and said what happened, they said i had to wait and see or call bhm to cancel

him - you should have nothing to worry about, your package will ship wednesday ill email you tracking number

 

me - (should have said) i thought you already shipped it, but i think we just ended there

 

this sux, coming from someone who doesnt have much money to begin with, bad luck for me lately

No one should order from BHM Golf. Brian is a crook! He uses the bait and switch, shows something on his website and then ships something else. We ordered Cleveland Graphite shaft clubs which he advertised on his website we even called and talked to him before we placed the order and he confirmed everything! We placed the order then he gave us the run around for 1 month when we finally received the order they were steel shafts. I had a bad feeling after about a couple of weeks that something was definitly wrong. I called the Chamber of Commerce in IL just to see if there was even such a place as BHM Golf, she informed me that he had several reports against him regarding the same issues that I was having and suggested I contact the Attorney Generals office, which I did and the BBB! I took the issue up with Cleveland Golf who was very willing to work with me to resolve the problem. They knew of Brian and are building a case against him to! I hope he gets thrown in jail! He deserves it!

 

Lesson learned if you are going to order a large value item CHECK OUT THE WEBSITE BEFORE YOU ORDER!
