Member asking for an irrational refund...

May 30th i sold a 716 T-MB 3 iron to a member. It was shipped on May 31 and he received it on June 3. He has had the club in hand and in play for 3 weeks. He is now threatening to blast me on the forums if i do not give him a full refund as he has lost the club head in a water hazard.

 

The sale itself included a lot of questions asked by him and answered to the best of my ability by me and that is completely fine (I also tend to ask a lot of questions when I'm buying an item). The club had an aftermarket shaft that was brand new, un-cut when installed and it was installed by the PGA Superstore.

 

He asked/threatened me for a full refund and offered to send me the shaft so I can "...take it up with the PGA Superstore..."

 

I honestly feel like 3 weeks in hand and in play on his part and without a full item returned I don't owe him a refund. What's my responsibility here?

Sounds like a tough break for the buyer to be honest. Weather we like it or not, not all clubs are built equally. You are buying something that someone else has built and you are doing so knowingly. If I buy a car used off craigslist, the minute I pay for it and drive it home it's on me. If said car breaks down on the way home, it's technically my fault for not bringing along a mechanic and test driving. I'll probably get blasted for my stance on this and so be it. Without more detail, and just going off what you have said here, I say "that's life sometimes".

There is no implied warranty on the BST, unless you specifically mentioned it. Some people just shouldn't buy used online, if they are not aware and accepting of the drawbacks/ dangers to getting a good deal on secondhand equipment.

How was he storing the club for three weeks? Was it cooking in the trunk of his car and loosening the epoxy? His garage? Going through lots of temp changes?

 

Given, it could have been a terrible build, but seems like regular use over three weeks would have shown up sooner.

Im not refunding anyone who cant return back what they purchased. Sounds like he pulled the head and wants to keep it at your expense.

If you are in a position to lose a club head into water, might want to take a lesson :)

 

 

That aside, 3 weeks is more than long enough, I dont think you owe him a dime.

If the first swing that was taken with it resulted in the head flying off that would be one thing, but with multiple uses before the head flew off that is out of the sellers control. Just like the used car example, what if buyer redlines the hell out of it and causes engine failure...is the seller responsible? Who knows if the end-user was using the item correctly and that is why there are too many variables to control in these situations.

 

I am of the opinion that any transaction of a used item is always assumed to be "Buyer Beware". That being said, if the seller actively deceived, withheld information, or masked a known issue then it is a different story. That is why the used market sees such drastic fall-offs in value from new; the buyer is assuming risk that would not otherwise be assumed had an item been purchased new.

thank you for the insight. i have tagged the member to this thread (@Kfar09). i agree with your sentiment that no implied warranty. i'm also not sure there would be a valid warranty claim for this situation even from a retailer either; i mean hypothetitcally (of course) - not an accusation, he could have pulled the head to sell or whatever and made the entire story up.

Not going to blast you at all, these situations do indeed fall on the buyer, especially for used clubs with aftermarket work. If you want 100% security, buy brand new from an authorized retailer/builder. The only time the seller will get blasted is if they sold something that they knowingly and willingly misrepresented, which does not appear to be the case here since the club worked just fine for 3 weeks. If the buyer tries to claim otherwise, I really dont think the first time you pull out a new to you 3i is on the course over a water hazard.

i agree wholeheartedly. i never put the club in play for an actual round but used it for a few range sessions (it just didn't fit my gaps). i never had a problem with it off of grass or mats. the club was pretty much pristine.

 

also, i even got a message from the buyer right after he received it telling me how much he liked it...

His problem, not yours. it's been 3 weeks and who knows what he did with it while playing.

 

People these days think private sellers are bestbuy and amazon.com and they can return things whenever they want. Nope!

So he hit it, it worked fine, then 3 weeks later he lost it.

 

Did he send a pic of the shaft? Wondering if it was a tip break or epoxy fail. Not that it matters.

Send him a box of tissues so he can boohoo all over those. Just kidding, kind of. Explain to him that it's unfortunate but that you are not a retailer and thus do not process warranty claims. And invite him to this thread so he/she can see that they're in the wrong with the threats and need to move on.

he did not send a picture of the shaft "which is fine", but he did offer to.

 

he also offered the confirmation of his 3 playing partners that he "wasn't using the club improperly". so i guess i've go that going for me.

yes - i did tell him that i was truly sorry that this happened but since he's had the club in hand and in play for 3 weeks there would be no refund given.

I've had an adapter fly off a shaft (taking the head with it) after probably 3+ weeks of use with the end result being that the adapter wasn't prepped correctly. If he can show some evidence of a bad/incorrect installation and hadn't furiously demanded a refund then maybe you could or can still work with him on it. Would be interested to hear his take before making a final decision.
