That's exactly it. There's a spot on your tax form to remit sales tax for online or out-of-state purchases that nearly everyone conveniently skips over.

Did you know it's illegal to have more than 3 month stickers on your license plate, worthy of a $50 ticket for improperly displaying the license plate? I learned that a few years back. I had up-to-date information across the board (license, registration, and insurance), I was driving at or below the speed limit, staying in my lane, and got pulled over for having my month sticker at the top right of my license plate be stacked 3 high.

 

Yes, we are all lawbreakers at some level or another. And just remember next time you're going 55 down the road: The only thing between you and the cars rocketing towards you is a vague social contract to stay on your side of the yellow line.

How does the tax thing on ebay work? Does the seller pay based such that we need to take this into account for it when pricing our item? Or is tax added onto the purchase price?

Bottom line: seller is responsible to collect taxes and pay the states.

I dont have a problem with the sales tax as long as it's a new item. I do find it ridiculous to pay sales tax on a used item. The sales tax was already collected when the original transaction happened, why does the state then get to collect again on the same item? And what if the item is bought and sold several times, tax collected each time....insanity!

 

A side note, the seller is not responsible for the sales tax, ebay is collecting the tax and sending it to the state. Anyone that has purchased on ebay recently will see 2 payments per transaction, one to the seller for purchase price plus shipping, and a second to ebay for the sales tax.

I feel the same way about used car sales here in CA. They collect on new and used car sales and there is no credit given on sales tax if you trade in a car. It's insanity

For VA, ebay has been charging buyers the tax since at least August. It's kinda lame, but you're supposed to pay the tax as a buyer so it really doesn't bother me. I'll keep buying on ebay.

The thing is my state law for online sales tax is if the seller does 100k in sales to customers in my state they have to collect tax , under that no tax. Almost all individual sellers would fall under the limit. eBay shouldn’t be collecting tax it should be up to the sellers. eBay is just a platform to sell just like any other e commerce software. Your not buying your clubs from eBay , you buy from an individual just like you would on Craig’s list.

I love when I read message board experts discussing tax issues, especially sales/use tax stuff.

I spent 20 years as a government auditor, primarily sales/use tax. Then I switched sides and am involved with a private tax practice. I sign off on over 600 tax returns a year.

 

The retailer is merely a conduit who collects and remits sales tax on all retail transactions. A retail sale is a sale to the final consumer of a product or service. Interstate commerce is NOT subject to state/local sales taxes, if the vendor has no physical location within the taxing jurisdiction.

 

Use taxes come in to play on transactions that are not covered by sales taxes. The ultimate consumer of a retail transaction that has no sales tax is subject to the use tax to the taxing jurisdiction. I have done sales/use tax audits that have resulted in seven figure liabilities.

 

E-Bay is merely making it easier for the retailer by doing the collecting and remitting of the tax.

99 percent of the items sold on ebay have already been taxed when purchased new. I kind of think its double dipping. Next thing you know I will pay tax on diapers and my daughter will have to pay another tax for wearing them... when will it end.

> Not entirely true. They do not take anything away from the seller for taxes, the buyer pays the applicable sales tax on top of the winning bid price.

Maybe I'm out of the loop, I don't buy on eBay, but I'm reading that you are upset that eBay is in business to make money, that PayPal is in business to make money, and that the state governments are making sure that the sales tax that is legally owed is actually collected and paid. I suppose the option is to rummage through used-club bins and visit yard sales, always paying cash.
