Hank Haney files suit against PGA

Oh please. Don’t give me “the father of daughters” faux outrage.

Im the father of two daughters and I stand by my comment. I’d tell my girls to tell hank to 1) F off and 2) let’s go play for 50 grand (if they were on the LPGA Tour). Why? They’re tough and can speak for themselves

Men are going to say things about women. Women are going to say things about men. It’s the way it is and no one is obligated to not share opinions - we have a constitutional amendment for that... fire away

Now, purely from a business standpoint, should Hank have said that? No. Not smart. BUT... you think he’s the only dude who thinks that way about the LPGA tour? If you do, you’re not very attune to men in general.

Oh, and is it ok for people to think what they want - and share those opinions - about anything at all including the LPGA tour? Absolutely.

Well, what do you think this is about? Business, right? This is not a constitutional debate, lol ; ) Nobody is saying he said anything not covered by free speech.

 

Finally, I did not “give you” anything. I provided a statement by a father who disagrees with HH. Take it up with him.

I'd be interested in reading the pleadings if anyone is so inclined to find them. A couple things stand out from this article. One, it appears there may be multiple plaintiffs, as the Tour's response refers to "Plaintiffs." I'd be interested to know who the other plaintiffs are. Also, based on the Tour's motion and Haney's response, it seems like his claim is for tortious interference and the Tour is not disputing that it interfered. This leads me to believe that the Tour's contract with SiriusXM doesn't give them power over the content of broadcasts, which I find odd. If the Tour had such a provision in the contract, they would argue that in defense rather than what they put in their motion.

If it is a motion to dismiss then yes, the allegations in the complaint are assumed to be true for purposes of determining the motion. Tour either believes the facts as stated don’t meet the requirements of whatever cause of action is asserted or maybe also or in the alternative is putting the motion out there to also include stuff that is more for PR than legal reasons. Pretty sure you need to sign up for PACER to pay to download any documents.

Tour arguments basically are (1) Haney's complaint states mostly conclusory allegations vs. specific facts regarding the Tour's interference and taken as true would not plausibly give rise to relief, and (more the meat of the arguments) (2) the Tour's interest in Haney's show through its relationship with Sirius (established by Haney) and the nature of Haney's remarks (established as inappropriate and offensive by Haney) permitted the Tour to interfere justifiably as a matter of law (taking as true Haney's allegation it did indeed interfere). Second one may have some legs and other facts asserted and things added to the motion of the Tour make pretty clear where its defense is ultimately headed. Prediction - even if he survives this motion, eventually and before trial he will likely have his case dismissed on summary judgment. Of course, you never know about "smoking guns", lol, but that would have to be some strange way the Tour managed to shoot itself in the foot, which would be pretty surprising, and Haney doesn't allege much that suggests he knows of any. Hilarious to me that Haney's lawyer actually pleads the Tour had been trying to ingratiate itself with the LPGA Tour - not real intelligent as a suggestion.
