Yellow / red penalty area defined differently by tee?

I played a hole yesterday that created a question in mind about the proper definition of a penalty area, and thought I'd put it to the ROG hive-mind. I suspect there is a well-defined answer to this one already.

 

Here's the scenario: par 3 hole, and from three sets of tees, the carry to the green is directly over a pond, which spans the complete distance from tee to green. There is a bail-out area to the right of the green, but for all intents and purposes, you must carry the water on your tee shot. It is (correctly, IMO) marked with yellow stakes / lines. My wife played from the most forward tees -- those are set to the RIGHT of the pond, and her shot did not need to carry any part of the penalty area to reach the green, or the right-hand collection area. A wayward shot pulled left could roll into the penalty area, though.

 

From those forward tees, the yellow penalty area seemed to be either incorrect, or overly penal, since the allowed relief areas for a ball that bounced in sideways just near the green would either be stroke & distance, or having to drop behind that point on the REAR tees (behind where the tee shot was taken).

 

Should such a penalty area be designated red from the forward tees, but yellow from the other tees? If so, how would a course indicate that for daily play (I understand that in a tournament, the Committee could mark it any way they choose).

Why would simply marking it Red from all tees be a problem? 

 

However I see no technical reason why the PA shouldn't be different for different tees.

I would suggest pairs of red & yellow stakes or one stake with two colours. But the situation should be clearly explained on the card in importantly a prominent notice on the tee.

Here is what it says in the Official Guide to the Rules of golf, page 386,

Status of Penalty Area May Differ Depending on the Teeing Area Used

Where carrying the ball over a penalty area, such as a pond on a par 3, is part of the challenge of a hole from the back tee but not from the forward tee, the Committee may decide to define it with yellow stakes or a yellow line and use a Local Rule to the effect that the area is a red penalty area when played from the forward tee.

In this case, it's very possible that a ball hit from the back tees hits just short of the green, and rolls backwards into the penalty area (think #12 at Augusta). From those tees, a yellow penalty area is the intent of the hole (perhaps with a drop area provided on a slightly forward tee), vs. being able to drop near the green where the ball last crossed the margin of the penalty area. From the most forward tees, it's definitely a classic red penalty area.
