As a guy who does some contract reading, it makes me wonder about the magnitude of a sale whereby you sell even your likeness. You've been using it for years and then you sell it. Wow. 

 

Its a business model I can't imagine, especially if you have been the guy, for years, like say a Jack Nicklaus, making all your own decisions. Now everything has to go through a company and you get a pre arranged slice.

I know I'm reading through an older thread, and maybe this has been answered....

 

Jack was selling only a part of his business, to represent a small minority part of the new business.   From an article in 2007:

 

"Jack Nicklaus has sold part of his company to billionaire New York investor Howard Milstein to help the golf legend expand the business.

Milstein's New York Private Bank & Trust paid $145 million for what's being called a significant minority stake in Nicklaus Cos. LLC, a newly formed company that acquired Nicklaus' golf-course design, marketing and golf-equipment businesses.

 

The Nicklaus family, which owns Golden Bear International Inc., will control a majority position in the new company. Nicklaus will serve as its chairman and chief executive officer."

Haha and I know being a programmer is what the cool kids tend to do these days but when I started this gig ... we were weird nerds in a dark room that no one wanted to talk about. And we made $16/hr. I LIVED THROUGH THE TORMENT!

Milstein neglected to mention that Nicklaus had previously and rightly requested arbitration per his employment agreement (an agreement of tremendous significance which Milstein ignores and continues to want to ignore) which Milstein was trying to dodge and filed the lawsuit specifically to 1. attempt to dodge arbitration, and 2. as a pretty obvious PR move to try and damage Nicklaus publicly for personal and weird business reasons.  Milstein was up to shenanigans, didn't want to live up to the terms of the employment agreement, and Nicklaus was out by his choice and not subject to any non-competition restrictions, among other things, and previously had contractual "permission" to do some of the non-consequential things Milstein claimed he did.  The whole Saudi thing was clearly an attempt to sully Nicklaus and take advantage of the whole "LIV" situation for Milstein's benefit, and that will likely come out later as well, one way or the other.

 

The New York Supreme Court for New York County will issue a ruling on the now court-filed request for arbitration at some point and it seems pretty obvious that Milstein will be ordered to submit to arbitration and that will proceed at some point, which will not be a public proceeding. What else comes of all this, who knows, but if you want to bet on an outcome, based on the agreements in place and Milstein's conduct, bet on Nicklaus having done nothing untoward or unethical, Milstein the opposite (and par for the course there) and, of course, nobody reporting on any of it, lol.

Anyway, I’ve made a prediction - remains to be seen if the court in the first place or an arbitrator after that agrees. And they could always settle.  So the final  “result” may not ever be made public.

Ah ok, so it's from the court filings themselves.  Gotcha.  I'll take your word for it on what you said.  If for no other reason than being willing to go through all that.
