Seller broke a contract to buy. Sold item without first giving notice of intent to void contract and sold item to another buyer

I messaged *****co19, Seller, this morning offering to put the ping dale 2.0 for $160.

Here is Seller response

'Sure Christopher...

The next message from Seller (about 8 hours later)

'nevermind, sold to someone else.'

 

I explained to Seller that we have a contract and Seller has the obligation to inform/alert Buyer about voiding our contract.

Seller response

'I waited 7 hours and you never paid…. It’s not sold till you pay.

 

please go ahead and ask the rest of GolfWRX. I’ve been selling here for over 10 years.

 

I believe I gave you ample time before I moved on.

Since Seller has been selling for over 10 years, Seller should be reminded by GolfWRX moderators about the etiquettes of buying and seller and basic Contract Law.

If you buy something it's expected that you pay immediately. If you didn't try and pay him/her for over 7 hours I see absolutely nothing wrong with them selling it to someone else.

Absent that, I'd say you didn't "validate" the contract if you will.

 

Also, sellers should probably just give the terms. "Sure, pay by XX:XX or agreement void."

For the Internet Lawyers who don't know: An oral (verbal) agreement can be every bit as legally binding as a written, signed contract.  But, as with all things in the law: There are details.  Then there's the issue of enforcing said contract.  (N.B.: IANAL, nor do I play one on TV.)

 

That being said: Looks to me like the Buyer failed to complete the transaction in what the Seller felt to be a reasonable time, so the Seller moved on.  As anybody who's watched B&S sections on Internet forums knows: It's not at all uncommon for buyers to say "I'll take it," and never be heard from again.  @Oneput, the next time you offer to buy something like this, perhaps it would be wise to clearly communicate to the Seller when he or she can expect payment?  I can understand your pique, but this one I think is your own fault.

How long should the seller have to wait before he moves on?  Is that specified in your “contract”?  When people don’t pay promptly the chances of them not paying at all go sky high.  I think most sellers would move on if they had a buyer ready with the funds…

What recourse does the seller have to recover in the case on nonperformance from the "buyer"? Or is this contract drafted with an embedded put option for the "buyer"? Did you advance some premium for that optionality? I'm not sure whether your coursework included Real Options as part of your Corporate Finance class or just covered Contracts and Torts in Business Law.

Again, I'm very sorry.  Threads like this make both of us look bad. I will learn from it. But most people who sell on Golfwrx know that just because someone said they will buy something, doesn't mean they always follow through. This is a first time for me that someone was upset because the seller moved on.

 

As I've stated in our personal messages, I've been selling on here for a long time. And maybe because of this I assumed since I didn't hear from you in 7 hours (I checked the time stamps), that you had changed your mind.

 

I think the big thing here is that there was a lack of communication on both our parts. If you told me you couldn't pay until later in the day we might not have arrived at this point. If I messaged you and told you someone else was interested... we may not have arrived at this point.

 

I hope that everyone who reads this thread can learn and make the classifieds section better.

This is simple. You needed a term on when payment was to be made and the goods despatched. This is not about stopping a sunami so May I suggest you move on.

As someone who has bought and sold on here quite a bit, I always pay immediately once the paypal name is confirmed. I find it very rude to wait longer that 30 minutes, as you are putting the seller in an awkward spot.
