Were you injured in any way? If so, find a local lawyer that specializes in personal injury claims. Otherwise, without damages, you have no viable claim.

It's a problem, and a serious issue. Companies rely upon customers being mute sheep and never bringing poor quality serivce, inferior products, and potentially harmful situations such as yours into the public forum. Take your issue to the corporate office of BR, and also speak with a local major newpaper to have an artie written after you have resolved the issue with BR.

Only really a serious issue if someone got hurt.

 

Personally I would go back, show the manager what happened and politely ask if maybe there would be any way they might consider some kind of freebies for your trouble!

Its only newsworthy if someone gets hurt (unfortunate, but true). If someone got hurt this would have the makings of a tidy little negligence claim.

 

Remember, from an earlier post, that negligence requires a duty; a breach of that duty; causality, both legal and proximate; and damages. Some shady PI attorneys would also argue that there is a fifth element of insurance coverage.

 

What you have here is an example of what is termed, "negligence in the air". Certainly, BR was negligent. But due to an absence of damages, that negligence is said to have been harmless, thus not actionable. This is actually a good thing, otherwise, everytime you disobeyed the speed limit someone would sue you for negligence. However, so long as your disobeying the speed limit doesn't cause you to hit something, it is not actionable.

Personally, I could never drink blades. My straw-striking just isn't that good. :)

 

 

 

In all seriousness, I'm glad you were not hurt. I don't know what kind of lawsuit you could have, considering no harm was actually done.
