A new driving range is being constructed on a golf course next to home site properties. Who would be responsible for property damage or injury to residents, the course, golfer or both. The homes were there before the course.

Here in Florida there was a case that made the news. A course had a hole running alongside a fairly busy road. A player pushes his shot into said roadway and hits/damages a car. Course tried to dump the problem onto the player.

Player hired an attorney and in the end the court decided that it was up to the owner of the course to protect surrounding properties include those that were mobile. The course owner (A large company) appealed unsuccessfully which was when it made the news. This was about 10 years ago or so - not sure if it still applies. But in the ruling, which was published, the judge made a statement to the effect that even though the best in the game can control their shots much of the time they cannot control them all of the the time and therefore it is the responsibility of the course owner to insure that surrounding properties are protected from the inevitable errant shots.

I will be looking forward to reading other comments to see if anyone can expand on this. As I recall the name of the company being sued was Tee To Green Golf by the way.

Unless the range makes you sign a waiver before you pay and get balls, I'd suspect that the course is liable.

Hopefully your property is on the left side of the driving range (from the driving bay point of view). Your average driving range hero is more prone to the slice than the hook....

My old home course had a similar type of hole. They had a big sign next to the tee that said that they we not liable for any damages caused.

In terms of the range I would assume that the owner of the range would be liable. You never signed anything saying you were ok with the range going in so any damage caused from it is their fault. I may be wrong but usually in order to buy a house along a golf course you have to sign waiver saying the course is not responsible or something along those lines.

One of the local courses recently disallowed drivers to be hit because so many people were slicing it over the net. There is a separate facility that runs along the net on the right side that had sustained damages along with cars in the parking lot. The players went crazy over it and now there are 2 signs on the left side of the range that players are allowed to hit drivers from. I still see people hitting drivers all the time from the right side and i'm sure a few balls sneak over from time to time.
