you own a trademark - patents expire. further, the designs from the companies may or may not have been patented, and since you've so plainly described they've been copied - it's safe to assume that the patent (if ever filed) would have expired by the time the other company came out with it. 

 

*added* furthermore - scotty cameron has been sued previously BY Seemore (no less) for the previous Red X2 putter b/c of the sight dot being a PATENT held by Seemore as an alignment tool explicitly for the use on their putters as proprietary technology/invention. Thus the joke about the seemingly close TRADEMARK of Seemore putters (logo) being on the putter as an alignment aid.

I’d be curious where the patent on 1 off’s falls in this case is it breaking trademarks too make a 1 off you never intend to sell?

This is likely the key thought that’s being ignored so far. It’s not being produced for distribution. It’s not being marketed to the public. It’s not being sold. It’s one putter for one player, not a retail product. 
 

I get that Scotty has a bad wrap for ripping off successful designs, so maybe I missed the sarcasm.
 

It’s kind of a shame though. Early in his career, he developed some innovative designs and quality products rather than “super” facelifts every year. He’s been mailing it in on name recognition and limited releases for over a decade now.
