I just read, on another site, a number of comments regarding errant golf balls doing damage to another person, or someone's property. An interesting conversation involving personal responsibility, umbrella insurance and, i suppose, honesty. 

 

My only 'errant' ball episode was my broken rear car window, near the chipping green. I sought the culprit but never found him/her.

A lot of it varies state to state, town to town, ad even if housing is around HOA to HOA. In regards to property damage. 

 

Also, intent is a factor as well from what I've seen at courses as well. I think this was highlighted pretty well in your attached link.

 

Usually, from what I've seen, in regards the damage it is one stated on the card on signage if the golfer is responsible. Also, usually if the course was there first, prior to housing there is no liability for the player as the homeowner is aware of the risk, and then the opposite if the houses were their first. Of course intentionally hitting at a house throws all that out the window.

Injury or damage claims are far to situational to generalize about. As for insurance coverage... as someone else stated get clarification from your carrier what exactly is or isn't covered. Regarding intent...generally it does not matter as accidental damage by definition assumes that there is no intent. If there is intent to do damage or harm you enter a whole different realm of liability as well as likely having opened the door for criminal prosecution. In such a situation it is also doubtful that your insurance is going to cover any deliberate actions causing harm or damage.

My simple advice:     "If you hit/break something - say something.  

 

Based on the varied caselaw and local rules - it's impossible to have ironclad rules anymore.   But it starts with owning up to your responsibility.   If you break it - tell someone - and maybe things will work out in your favor.  And if not - you were at least honorable.

 

It's what you probably would want to happen if YOU were the victim.
