Failed BST Transaction

I don't mean to sound dense, but don't you need to be 18 to enter into a contract with someone which is why eBay has an age restriction? So wouldn't suing him result in the case being dropped? Seems to me that the only way to be made whole is to get in contact with the parents + his golf coach at school and hope they make him do the right thing

 

Edit: please correct me if I'm wrong. I don't have a legal background. Just took a class in school a few years back.

Member for around a year, zero posts, 1 feedback score. Sucks you had this done to you OP, the blame is certainly squarely on the other guy. But I'd suggest choosing safer trade partners in the future, or figuring out some way to protect yourself.

 

Everybody always says "it's not just the people that have to buy their way on to the BST that do these things", but amazingly it's pretty much always the guys that have to buy their way on to the BST that do these things (like 99% of the time)...

I wonder if it's the kid in this video, he's even a lefty, current sophomore at Dana Hills High School maybe? I can see a kid pulling a scam like this, maybe the person who uploaded the below video needs to receive a message...

Did I read that the kid claimed to send them back, and USPS tracking shows as "delivered"? What's the story there, OP?

Sounds like a fake tracking number was given, but doesn't the tracking info say the date the number was created (and the location shipping from) plus the destination location zip code and address? Almost impossible for a person to fake this unless he just shipped a random box to your zip code and then used that tracking number to try and fake you out.

 

These threads lately are making almost never consider a trade no matter how good of a deal it seems. WAY to easy to get screwed. Give me cash money or move on. At that point you might as well just do a long winded buy-sell, where he sends you his clubs, you send him collateral money... you make sure it's legit, then you send your clubs to him, and he gives you collateral money.. he checks everything out, then you both exchange the collateral back again. If people decide to be jerks and opt out, you at least both got paid to "hold" the others clubs. At that point it's not even worth the hassle and you're still basically buying and selling goods, not really trading.

Or just do some diligence- choose trading partners who have been contributing members here for a while and have strong feedback. Communicate with them a little and get a feel for them based off of their communication (how fast are they to respond? do they give more than one-word answers? are they willing to take the time to send extra photos? etc.).

 

I'm not the least bit afraid of trading here, and I've never done a money swap or a "you send then I'll send" situation. You just have to be a little more selective when trading and really narrow down your pool of who you're willing to trade with versus who you're willing to buy/ sell with.

 

Like I said, the blame is 100% on this kid. But the OP really couldn't have chosen a riskier person to trade with, unless they had just joined within the week.

Looking back, it was certainly risky to trade on my part. But throughout our preliminary text exchange, multiple pictures of the clubs were traded and everything seemed on the up and up. I've learned to be more diligent in future dealings.

 

With that said, I still don't have the Miura's that we agreed to trade or my Callaway prototypes. I know the young man has communicated with the golfwrx mods and has been linked to this thread. Through the help of some great minds on this site, in addition to the shipping address, I also have contact information for his parents and his high school golf coach. I would like to give this young man 24 hours to produce valid tracking information for the return of my clubs before contacting those folks. I think that is more than reasonable.

Waiting only gives this kid time to come up with excuses and schemes.

 

I’d contact them all asap and let them to apply pressure to this kid. You are basically powerless. Let them teach him a lesson. And direct them all to this thread.

 

If he only ships your clubs back to you because he’s scared, he learns nothing. And probably continues to do what he does...

Did you contact OP from other Miura thread? I don’t know about you, but worth reading thread as this could be linked....Miura “no show”, shaft issues, NC? May be worth reaching out....

 

Also, I’m sure everything sounded as if it was on the up and up, otherwise thieves would have no success in there scams… So no matter what the situation how good it looks, or how comfortable you feel, that’s what people do to take advantage of your vulnerability when they rip you off

I'd put it into the hands of LEO, and once you get your stuff back, let this kid, and his parents, deal with the fallout. If the police want to have charges dropped, that is a call to be made in the future. But, allowing this to go on without any "legal" entities getting involved will only teach this kid how to get away with things....he gets a free set of clubs and an education on how to scam. Do it with LEO involved, you will get your clubs back, and this kid will get a lesson of another kind...and, hopefully, will put an and to his scheming.

I am still a little thrown off by this comment in the OP, "despite the claims that he shipped them over a month ago and that his tracking information shows that they were delivered." How did he ship the irons (or a box that looks like it could contain irons) and they showed as delivered, but you didn't get them? Why isn't this a USPS claim at this point if the irons were lost in transit?

 

Did you never receive a tracking number to verify it against and it's just his word that they were delivered?

 

Did he ship something to a bogus address or himself and upload that tracking number?

 

Did he upload/ share a valid tracking number that had nothing to do with your irons just to get you off his back?

 

Where did it say it was delivered? The USPS tracking system will tell you where, when, and by whom it was delivered.

That's what I'm asking. I know that the USPS tracking website (or, their new fancy name "informed delivery") will at least say delivered to door/ front porch, Cuyahoga Falls, OH 44223 (in my case). If the kid is located in NC, and the OP is located in WV, the tracking should tell him if it was delivered to the town he lives in at least, and not some other rando town.

 

*edit- if that doesn't match up, then start calling with the tracking number to find out as much info as you can on it. If it's a fake tracking number, be prepared to call him on it with facts.

OP should just screen shot the tracking info when it's entered into the logistics website. If he took the kid's word for it (that it was delivered) then that's an easy call to the PD & his parents (and also extremely naive on OPs end). If the tracking is somehow legit and they were sent to the right place and USPS or whomever lost them... then it's a claim thru that company and the kid is (kind of?) absolved, even though if that ends up being the case, poorly handled.

 

Although now that I'm thinking of it... there's slim to none chance they'd get marked as "Delivered" if in fact the item was never actually put out on a truck. I once "lost" an item with USPS that said delivered. The issue was that many times USPS marks an item as delivered once it reaches the host USPS office. The mail man, who was new, kept trying to leave it at my door, but assumed the object was expensive (because it was heavy) and kept putting it back on the truck. I had to call the USPS office and direct them to tell the mail carrier to leave it and to stop waiting for me to be home.

 

So it could possibly be sitting in his local USPS in that case.

This is the most confusing part for me....confirmed tracking numbers, were their pictures of receipts? Wish could be more clarified

Well you shipped him clubs did you not? He'd know the return address for these clubs and technically could assume to send back to this address.

 

 

I'd try to contract him/parents and demand proof of shipment and delivery. If they can't/don't, next step is a police report and small claims. I'd leave the coach out simply because he's not legally responsible and just adds another layer of confusion and complexity.
